Intent to sell or distribute controlled substance charges are taken even more seriously than possession charges. The consequences of an intent to sell or distribute a controlled substance charge in Virginia are as follows:

  • Possession of a Schedule I or Schedule II controlled substance: A felony, which may warrant between 5-40 years of incarceration and a potential $500,000 fine. For a second offense, you may face a maximum of life in prison and a potential $500,000 fine.
